Terms of Service

These Terms of Service ("Terms") constitute a binding agreement between you and Offensive Cyber & Intelligence Capability Solutions Pvt. Ltd. ("OCIC Research", "we", "us", or "our"). By accessing or using our website, publications, or services (the "Services"), you agree to be bound by these Terms.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization. If you do not agree to these Terms, you must not use the Services.

• "Services" means our website, research publications, advisories, tools, and any related offerings.
• "Content" means all text, research, advisories, code, graphics, and other materials made available through the Services.
• "User", "you" means any person or entity that accesses or uses the Services.
• "Engagement" means a separately contracted professional services arrangement, which is governed by its own agreement.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for lawful informational and professional purposes, subject to these Terms.

You must comply with all applicable laws when using the Services and must not use them in any way that could damage, disable, overburden, or impair our systems or interfere with any other party’s use of the Services.

Our publications and advisories are provided for educational, defensive, and informational purposes to help organizations understand and mitigate security risk. They describe offensive techniques solely to enable defence.

You agree to use our Content responsibly and lawfully, and only against systems you own or are explicitly authorized to test. You must not use our Content to facilitate unauthorized access, harm, or any unlawful activity. We disclaim responsibility for misuse of information that is published for defensive purposes.

The Services and all Content, including trademarks, logos, research, and software, are owned by or licensed to OCIC Research and are protected by intellectual property laws.

You may view, download, and share our publications for non-commercial, informational use with attribution, unless a specific item states otherwise. You may not reproduce, modify, sell, or create derivative works from the Services for commercial purposes without our prior written consent.

You agree not to engage in any of the following while using the Services:

• Attempting to gain unauthorized access to our systems, accounts, or networks.
• Scraping, harvesting, or bulk-extracting Content except as expressly permitted.
• Introducing malware, conducting denial-of-service activity, or disrupting the Services.
• Misrepresenting your identity or affiliation, or impersonating OCIC Research.
• Using the Content to plan, enable, or carry out unlawful or harmful activity.

Authorized security testing of our own assets is governed by our Responsible Disclosure Policy, not by this clause.

The Services may contain links to third-party websites or rely on third-party providers. We do not control and are not responsible for the content, policies, or practices of any third party. Accessing third-party resources is at your own risk and subject to their terms.

The Services and Content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Our research reflects findings as of the date of publication and may become outdated. Nothing in the Services constitutes legal, financial, or professional advice, and you rely on the Content at your own discretion and risk.

To the maximum extent permitted by law, OCIC Research and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services.

To the extent liability cannot be excluded, our total aggregate liability arising out of or relating to the Services is limited to the greater of the amount you paid us to access the Services in the preceding twelve months or INR 10,000. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless OCIC Research from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Services, your violation of these Terms, or your infringement of any rights of a third party.

We may suspend or terminate your access to the Services at any time, with or without notice, if you breach these Terms or if we reasonably believe your use poses a risk to us, other users, or third parties.

Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles. Subject to applicable law, the courts at our registered office location in India have exclusive jurisdiction over any dispute arising from these Terms or the Services.

Before commencing formal proceedings, the parties will attempt in good faith to resolve any dispute through discussion. Nothing in this section prevents either party from seeking urgent injunctive relief.

We may revise these Terms from time to time. Material changes will be reflected by updating the version number and the "Last Updated" date in the metadata above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
